Online purchase terms
In force from 30.09.2026. By paying online you accept the terms of both documents below. This is a convenience translation. The Azerbaijani text is the legally binding version.
Public offer — agreement on online prepayment for dental treatment
1. General provisions
1.1. This document is a public offer by the Smile by Dr. Bakhtiyar clinic (Tax ID/VÖEN 1005630701, address: Babek Avenue 1131, Babek Plaza, Khatai district, Baku; director: Dr. Bakhtiyar Aliyev; hereinafter “the Provider”) to any individual who wishes to prepay dental treatment online via the smilebydrbakhtiyar.com website (hereinafter “the Customer”).
1.2. Successful completion of the online payment on the website constitutes full and unconditional acceptance of all terms of this offer. From that moment an agreement between the Provider and the Customer is deemed concluded.
1.3. This offer and the “Refund rules” are integral parts of a single agreement. After payment the Customer receives a personal contract (PDF) showing their name, the treatments chosen and the amount paid.
2. Definitions
2.1. Treatment — a dental service listed in the Provider’s price list and offered on the website for online purchase.
2.2. Online price — the amount calculated with a 10% discount on the price-list price and paid online.
2.3. Coupon — a unique code (format SM-XXXXXX) confirming the online payment and the Customer’s right to receive the paid treatments.
2.4. Order — one or more treatments (each in a given quantity) bought with one payment; one coupon is issued per order.
3. Subject of the agreement
3.1. The Provider undertakes to provide the treatments chosen by the Customer in the quantity stated on the coupon, and the Customer undertakes to prepay their online price.
3.2. The maximum quantity of one treatment per order is shown on the website.
4. Ordering and payment
4.1. The Customer chooses treatments and quantities on the website and enters their name and phone number. The number is verified with a one-time code sent to WhatsApp.
4.2. Online purchase is only possible with an Azerbaijani mobile number (+994) and a bank card issued by a bank in Azerbaijan.
4.3. Payment is made in Azerbaijani manat by bank card through the Payriff payment system (Kapital Bank). Card details are not passed to or stored by the Provider.
4.4. After successful payment, the coupon code, amount paid, coupon validity and the personal contract are sent to the Customer’s WhatsApp.
4.5. The online price in force at the time of payment does not change for the whole validity of the coupon — even if the price list later rises, no extra payment is required from the Customer.
5. Coupon validity and use
5.1. The coupon is valid for 3 (three) months from the payment date.
5.2. The appointment time is agreed with the Customer by phone +994 55 501 01 07, via WhatsApp or the clinic’s bot. The coupon code is presented on arrival at the clinic.
5.3. Treatments on the coupon may be used in one or several visits, in parts (for example, one of 3 implants in one visit and the rest in later visits).
5.4. By agreement with the Provider, the coupon may be transferred to a family member of the Customer; the treatment is then provided to that person.
5.5. When the coupon expires, the unused amount is handled under clause 5 of the “Refund rules”.
6. Medical conditions
6.1. Treatments are provided on the basis of the doctor’s clinical examination and assessment. Online payment does not replace the doctor’s medical decision.
6.2. If at the examination the doctor finds a medical contraindication or recommends a different treatment, the matter is handled under clause 3 of the “Refund rules”.
6.3. If additional treatment is needed, it is agreed with the Customer separately and is not included in the coupon amount.
7. Rights and obligations of the parties
7.1. The Provider must deliver treatments to a high standard in line with its valid licence and medical standards, offer the Customer appointment times within the coupon validity and keep medical confidentiality.
7.2. The Customer must give accurate information about themselves, fully inform the doctor about their health, attend the agreed appointment and, if unable to attend, give at least 24 hours’ notice.
8. Refunds
All questions of refunds, changing a treatment and coupon expiry are governed by the “Refund rules” on this page.
9. Personal data
The Customer’s name and phone number are used only to fulfil the order, send the coupon and contract and arrange the appointment, and are not shared with third parties (except as required by law). Details: smilebydrbakhtiyar.com/mexfilik.
10. Liability and force majeure
10.1. The parties are liable for non-performance of their obligations under the legislation of the Republic of Azerbaijan.
10.2. In force majeure circumstances (natural disasters, epidemics, decisions of state authorities, etc.) the coupon validity is extended for the duration of those circumstances.
11. Dispute resolution and final provisions
11.1. Disputes are resolved by negotiation and, failing agreement, in court under the legislation of the Republic of Azerbaijan.
11.2. The Provider may amend this offer; amendments take effect upon publication on the website and do not apply to coupons already paid — those remain under the terms in force at the time of payment.
Payment refund rules
1. At the Customer’s request — unused coupon
1.1. Within the coupon validity, if none of the treatments on the coupon has been used, the Customer may request a refund without giving a reason. The amount is refunded less the payment system fee (3%).
1.2. The payment system keeps its fee on refunds too; this fee is not the Provider’s income.
2. Partly used coupon
2.1. If part of the treatments has been provided, only the value of the treatments not provided is refunded, calculated at their paid (discounted) online price.
2.2. The refund is made less the payment system fee (3%) (clause 1).
2.3. The value of medical treatment already provided is not refunded.
3. When treatment cannot be provided for medical reasons
3.1. If at the examination the doctor finds a medical contraindication or recommends a different treatment, the Customer chooses: (a) a full refund of the amount paid without any deduction (the Provider covers the payment system fee); or (b) transfer of the amount to the recommended other treatment.
3.2. When the amount is transferred, the online discount also applies to the new treatment. If the new treatment costs more, the Customer pays the difference; if less, the balance is refunded to the Customer in full.
3.3. Refunds under this clause do not depend on time limits, and no fee is deducted from the Customer.
4. When the Provider cannot provide the treatment
If, for reasons on its side (doctor unavailable, equipment, etc.), the Provider cannot provide the treatment within the coupon validity, at the Customer’s choice the coupon is extended or the amount paid is refunded in full — the Provider covers the payment system fee.
5. When the coupon expires
5.1. When the 3-month coupon validity ends, the right to the online discount on unused treatments is lost, but the amount paid is not forfeited.
5.2. Within 12 months after expiry the Customer may choose: (a) to apply the unused amount to any clinic treatment at the current price-list price; or (b) to have the amount refunded less the payment system fee (3%).
5.3. If the Customer applies before expiry with a valid reason (illness, business travel, etc.), the coupon may be extended once by 1 month.
6. Refund procedure and timing

6.2. The Provider reviews the request within 3 (three) working days and informs the Customer of the outcome.
6.3. Money is refunded only to the bank card used for the payment. Depending on the bank, crediting usually takes 5–10 working days.
6.4. Cash refunds are not made.
